SMS Terms of Service

These SMS Terms of Service (“Terms”) govern your participation in the Ace SMS program operated by Bohannan Holdings, LLC (“Bohannan Holdings,” “we,” “us,” or “our”). Ace is a business operations assistant that sends and receives two-way SMS with Brandon Bohannan and opted-in contacts (coworkers, vendors, and partners) for operational coordination, scheduling, status updates, and customer-care style replies. Ace is not a bulk marketing blast program.

By opting in to Ace SMS, you agree to these Terms and our SMS Privacy Policy.

1. Program Description

Ace provides conversational SMS support for Bohannan Holdings business operations, including:

• Operational coordination with teammates, vendors, and partners
• Scheduling and appointment-related updates
• Status updates on tasks, deliveries, or open items
• Customer-care style replies related to Bohannan Holdings activity

Messages are transactional / conversational in nature and are sent only to people who have opted in.

2. Eligibility and Consent

You must be able to form a binding contract and must use a mobile number you own or are authorized to use. Opting in to Ace SMS is voluntary and is not a condition of purchasing goods or services from Bohannan Holdings.

3. Message Frequency

Message frequency varies. When you are in an active conversation with Ace, you typically receive fewer than a few messages per day. Volume depends on your requests and ongoing operational needs. We do not send high-volume marketing campaigns.

4. Message and Data Rates

Message and data rates may apply. Your mobile carrier’s standard messaging and data charges apply to messages you send to or receive from Ace. Check with your carrier for details about your plan.

5. HELP and STOP Instructions

For help, text HELP to +1 (817) 518-2066 or email brandon@bohannanholdings.com.

To cancel, text STOP to +1 (817) 518-2066. After you send STOP, you will receive a one-time confirmation that you have been unsubscribed, and you will no longer receive Ace SMS messages unless you opt in again. You may also reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT where supported.

Supported keywords (as available on the platform): START / HELLO (opt in), HELP, STOP.

6. Privacy

Your privacy is important to us. Please review our SMS Privacy Policy, which explains how we collect, use, and protect mobile information related to Ace SMS. We will not share or sell your mobile information to third parties for their marketing or promotional purposes.

7. Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission by your wireless carrier and is not guaranteed. Bohannan Holdings is not responsible for delays, failures, or undelivered messages caused by carriers, networks, device settings, or factors outside our reasonable control.

8. Acceptable Use

You agree not to use Ace SMS to:

• Send unlawful, harassing, abusive, or fraudulent content
• Impersonate others or misrepresent your affiliation
• Attempt to probe, disrupt, or overload the messaging system
• Share content that infringes others’ rights

We may suspend or terminate messaging access if we reasonably believe these Terms have been violated or if required by law or carriers.

9. Changes to the Program or Terms

We may modify Ace SMS features or these Terms at any time. Material changes will be reflected by updating the “Last updated” date on this page. Continued participation after changes become effective constitutes acceptance, except where additional consent is required by law. You may opt out at any time by texting STOP.

10. Disclaimer of Warranties

Ace SMS is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Bohannan Holdings disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that messages will be uninterrupted, timely, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Bohannan Holdings and its officers, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to Ace SMS, even if advised of the possibility of such damages. Our total liability for any claim related to Ace SMS will not exceed one hundred U.S. dollars (US $100), except where prohibited by law.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where mandatory consumer protections of your jurisdiction apply.
